TapeStories Legal Information
Terms & Conditions
These terms explain how TapeStories operates, how website enquiries are handled, and the basis on which archive and private digitisation submissions may be accepted.
These Terms & Conditions apply to the use of the TapeStories website and to enquiries, archive submissions and private digitisation requests made through the website, email, WhatsApp or any other communication channel operated by TapeStories.
References to “TapeStories”, “we”, “us” or “our” mean TapeStories Limited, once incorporated and trading, or the TapeStories project operator before formal incorporation.
1. Website Use
You agree to use this website only for lawful purposes. You must not use this website to submit unlawful, offensive, harmful, misleading or infringing material.
2. Enquiries Are Not Automatic Acceptance
Completing a form, sending a WhatsApp message or emailing TapeStories does not mean your tapes have been accepted. TapeStories will review enquiries and may accept, refuse or request further information at its discretion.
3. Free Archive Submissions
Free archive digitisation is offered only for selected tapes accepted by TapeStories. If accepted, contributors must agree to the applicable Submission Terms before sending tapes.
For Free Archive Submissions, the contributor is responsible for sending tapes to the address provided by TapeStories and for all associated postage or delivery costs.
Unless agreed otherwise in writing, physical tapes submitted under the Free Archive Submission route become the property of TapeStories once received, are not returned, and may be recycled or disposed of after digitisation.
4. Archive Rights and Use of Footage
By accepting the Free Archive Submission terms, contributors grant TapeStories the right to digitise, preserve, edit, archive, publish, share, display and use selected footage for storytelling, social media, documentary, promotional, educational and commercial purposes.
5. Private Digitalisation — Paid
Private Digitalisation is a paid service. TapeStories will contact you first to confirm tape types, quantities, pricing, payment details and practical arrangements before any tapes are sent.
Private Digitalisation footage remains private and will not be published by TapeStories unless separately agreed in writing.
6. Copyright and Third-Party Rights
Some tapes may contain copyrighted material such as television broadcasts, films, commercial music, recorded movies or other third-party content. TapeStories will not knowingly publish content where publication would infringe copyright or third-party rights.
Contributors confirm they have the right to submit the tapes and any personal footage included in them. TapeStories may refuse to publish or may remove material where copyright, privacy, safeguarding, reputational or legal concerns arise.
7. No Guarantee of Restoration
Old tapes can be damaged, degraded, mouldy, incomplete, blank or unplayable. TapeStories cannot guarantee that every tape can be successfully digitised, restored or recovered.
8. Limitation of Liability
To the fullest extent permitted by law, TapeStories is not liable for indirect loss, loss of sentimental value, loss of opportunity, data loss, degradation already present on tapes, or damage arising from age, prior storage conditions or physical condition of tapes.
9. Changes to These Terms
TapeStories may update these terms from time to time. The version published on the website at the time of submission will apply unless otherwise agreed in writing.
